These terms govern your use of wagglebean.com (the "Site"), operated by xTechnix Inc. ("xTechnix," "we," "us," or "our"), doing business as Wagglebean. By visiting or using the Site, you agree to these terms. If you don't agree, please don't use the Site.
Wagglebean.com is currently a catalog and information site showcasing our product designs. It does not process orders, payments, or accounts. Where a product page notes it is "design finalized," that describes the state of the design and print files, not confirmation that the item is available for purchase, has completed physical safety or durability testing, or is currently in stock. Items in the Lab are explicitly early-stage prototypes. We'll update a product's status here as it changes.
The Wagglebean name, the paw-and-bean mark, product names (such as WagglePocket, WaggleDuo, WaggleReserve, Wild + Tide, and Pocket Pals), and all designs, renders, photographs, and text on this Site are original work owned by xTechnix Inc. unless otherwise noted, and are protected by applicable intellectual property laws. You may view and share pages of this Site for personal, non-commercial purposes. You may not reproduce, redistribute, reverse-engineer, or create derivative works from our designs, 3D models, or brand assets, or use our name or marks, without our prior written permission.
Wagglebean is a working brand name that has not completed trademark clearance; this does not waive any rights xTechnix Inc. holds or may come to hold in it.
You agree not to use the Site to: violate any applicable law; attempt to gain unauthorized access to the Site or its underlying systems; interfere with the Site's normal operation (including scraping at a disruptive rate or attempting to bypass security controls); or misrepresent your affiliation with us.
We try to keep product descriptions, dimensions, materials, and testing status accurate and current, and we deliberately flag when a design is still a prototype or hasn't completed physical testing. That said, the Site and its content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and without any warranty that the Site will be uninterrupted, secure, or error-free. Rendered product images are digital visualizations of the actual printable design; printed color and texture can vary by filament batch, lighting, and screen. Some lifestyle images are AI-generated visualizations and are captioned as such where used.
Wagglebean items are small, 3D-printed objects. Where a page notes a design hasn't completed physical fit, durability, or safety testing — including everything in the Lab and Travel Essentials — you understand it is an early prototype and use, handle, or request one at your own risk. These items are not toys, are not evaluated by any regulatory body, present a choking hazard from small or detachable parts, and are not intended for children under 3 (or any child prone to placing small objects in their mouth) unless a specific page says otherwise. Pocket Dose is an outer carrier only, subject to the additional caveats on its own page, and is never child-resistant or a substitute for proper medication storage. Follow any assembly, care, or safety notes on a product's own page; if none are given, use ordinary care appropriate for a small printed-plastic object.
The Site links to third parties we don't control, including xtechnix.com and social platforms. We aren't responsible for the content, policies, or practices of third-party sites, and a link doesn't imply endorsement.
To the fullest extent permitted by law: (a) xTechnix Inc. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, use, profits, or goodwill, arising from or relating to your use of, or inability to use, the Site or any Wagglebean item — even if we've been advised of the possibility of such damages and even if a remedy fails its essential purpose; and (b) xTechnix Inc.'s total, aggregate liability for any claim arising from or relating to the Site or a Wagglebean item will not exceed the greater of (i) one hundred U.S. dollars ($100), or (ii) the total amount you paid xTechnix Inc. for the item or service giving rise to the claim in the twelve (12) months before the claim arose. These limits apply regardless of the legal theory the claim is based on (contract, tort, statute, or otherwise). Nothing in these terms limits liability where it can't be limited under applicable law — for example, liability for our own gross negligence, willful misconduct, or fraud, or death or personal injury caused by our proven negligence, to the extent such liability cannot be excluded under Maryland law.
You agree to indemnify and hold xTechnix Inc., Wagglebean, and their officers, employees, and agents harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these terms, your misuse of the Site, or your violation of any law or the rights of a third party.
If a dispute arises, please contact us first at support@wagglebean.com — most concerns can be resolved informally and quickly. If a dispute isn't resolved that way and proceeds to litigation, you agree that it will be brought exclusively in the state or federal courts located in Maryland, and you consent to personal jurisdiction there.
If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. These terms, together with our Privacy Policy, are the entire agreement between you and xTechnix Inc. regarding the Site, and supersede any prior agreements on the same subject. Our failure to enforce any part of these terms isn't a waiver of our right to do so later.
We may update these terms as the Site evolves — particularly once ordering, accounts, or payments are introduced, which will come with their own additional terms. We'll update the "last updated" date above when we make changes. Continuing to use the Site after an update means you accept the revised terms.
These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles.
